Complaint on Officer Fred

Re:            Homeowner Complaint on Officer Fred
On Monday, June 28th, between 8pm and 9pm, Officer Fred responded to complaint calls about kids swimming in the lake at and near the Diamondhead Marina.
Upon initial contact with the young men, Office Fred began using profanity and abusive language, in violation of Arkansas Criminal Code covering disorderly conduct..  The oldest boy came out of water to speak to Office Fred, while the other 5 remained in the water. In response to these five boys not immediately exiting the water, Office Fred, according the Arkansas Criminal Code, statute 5-13-301,  did make terroristic threats in the first degree upon these youth.  His words, according to my three sons as well as the three other boys threatened: “The next time you kids try to hide from me, I’ll jump in there and drown you.”
See attachment for definition of Terroristic Threatening in the first degree. Terroristic Threatening in the first degree is a Class D felony.
Also on scene, driving up on golf cart was a Diamondhead property owner who’ve I’ve not yet identified, but will- who suggested to Officer Fred, “ You should shoot them”.   According to all youth present, Officer Fred responded “Ha Ha, I will have enough bullets too.”
As of today, June 29th, 2010, I am requesting that Officer Fred be removed from his position of authority in the Diamondhead Community.  I will be pursuing further sanctions against the possibility of Officer Fred working in a law enforcement capacity anywhere in the state of Arkansas.  This letter should be viewed as a formal complaint against officer Fred, as well as the Diamondhead Police Department and the Diamondhead Community.  Please provide a written response within 24 hours in regards to planned action against Office Fred and the Diamondhead Police Department.

Dear Mr. Belz:

Please accept this letter as notification of a formal complaint.

The Complaint is being filed against; Diamondhead POA, the Diamondhead Police Department, and a Diamondhead Patrol Officer identified here-in only as Officer “Fred”.

The Complaint is being filed by Michael and Kimberly Gilsinger on behalf of our minor child Jarrett Gilsinger, as Diamondhead Property Owners.

It is my understanding that on Monday, June 28th, 2010 sometime between the hours of 8pm and 9pm that Officer “Fred” confronted 6 individuals swimming in Lake Catherine near the Crazy Yankee Docks. Five of these individuals are minor children, and one is an 18 year old male. My son, Jarrett Gilsinger is one of the five minor children.

According to statements provided by the children, Officer Fred threatened my son and the other children by verbally stating “The next time you kids try to hide from me, I’ll jump in there, I don’t care about getting wet, and I’ll drown you.” This statement was delivered in a serious and aggressive manner and was interpreted as a literal threat by the children. Although my son did not hear all of the conversation between Officer Fred and the other children, he did hear one additional comment made by Officer Fred stating “I have enough bullets in my pocket too”. My son was then told by the other children that this comment was made by Officer Fred in response to another adult Male passerby’s suggestion to Officer Fred that “You should just shoot them”. My son is very upset as a result of this situation.

As Parents and Property Owners in Diamondhead we find Officer Fred’s behavior offensive and reprehensible. Additionally we believe Officer Fred is in violation of Arkansas Criminal Code Section 5-13-301(a)(1)(A), Terroristic threatening, which states;

“A person commits the offense of terroristic threatening in the first degree if:
(A) With the purpose of terrorizing another person, the person threatens to cause death or serious physical injury or substantial property damage to another person”
Because of his actions we are requesting that Officer Fred be permanently removed from the Diamondhead Police Department immediately.

We request that that you respond to our complaint in writing by Midnight July 1st, 2010.

Board Meeting - 7-22-10

Board Meeting began at 7pm with President Massey asking for a moment of silent reflection.
The Board approved the June 24, 2010 minutes.

Tresurer's Report - Terry Shipp read his Financial Highlights, which will be posted separately from the notes.
Some of his comments:

  • 28 lots have been turned back to the POA. 5 of these lots are common property lots that are used by the community. 23 lots are turned over to Diamondhead Reality at $300.00 each.
  • Golf Membership stands at 86. Terry Shipp; “I think the lesson we can learn here and try to overcome is … the more we raise the price the less revenues we have.
Treasurer’s Report was approved as read.

New Business

  • The lease is up for 6 golf carts. Todd Belz made a request to purchase these carts at $1,500.00 each, for a total of $9,000.00. This motion was made by Tom Lockette and seconded by Tom Wright. Passed unanimously.
  • Someone in our community, who wishes to remain anonymous, has graciously provided artwork to display in our Country Club. A motion was made and seconded to accept this gift. Motion passed unanimously.
  • Frank Pohlkamp explained that the Board has their first home foreclosure. “This may be the first of many, so, we better learn how to deal with this kind of thing.”
President Massey asked the members of the community to stay while the Board took a few minutes to adjourn to Executive Session.

Board Meeting re-convened. President Massey read the following letter:

Dear Mr. Massey,
Please accept this letter as my resignation as General Manager of the Diamondhead Property Owners Association. It has been a genuine pleasure working for Diamondhead Board of Directors during these past three years.
If I may be of any assistance in the training of my replacement, please know that I will gladly make myself available to this effort.

General Manager - Resigns

During the Board Meeting, last evening, Raymond Massey - President, read the resignation letter from General Manager, Todd Belz.  The resignation was accepted by the Board.  Todd will remain our Golf Pro.

Police Officer shot

Fred Ensminger is the name of the part-time, Off Duty, Diamondhead Police Officer that was shot last evening by a member of Diamondhead.   Fred under went surgery today to remove the bullet from the bone in his shoulder.   Your prayers are appreciated.
Board President, Raymond Massey explained the investigation has been turned over to Garland County; authorities outside of Diamondhead Community.  Mr. Massey wanted to make it clear that the situation 'is under control'.

"Mr. Hannon informed the community that the DH budget for insurance for this year is $69,692.  'Todd, Tom Wright and I met with 4 different brokers.  The renewal premium came in at $49,262.  This is 29% below the budgeted amount.  This broker is the one we have had for over 10 years and is the only one who covers all the exposures that we have.  There are very few Insurance Companies that will cover a police department.'"  This quote from the Town Meeting notes was used in a U.S. District Court case - dated Jan. 31, 2013

Roads

The POA office has received a lot of phone calls asking when the road work is going to begin.

First of all I want to apologize for all of the dust the roads have created. When we had the bad pot holes on Diamondhead Drive and Plum Hollow, I thought it was a good idea to go ahead and cut out those bad areas to make it safer to drive on. Little did I know we would have weeks without rain and the dust has created a lot of problems.

I spoke to Spa this morning and they are going to start chip and seal the week of July 19th.

Front Entrance will be Closed -- July 26th

Attention: The Front Entrance will be closed, and all traffic diverted to our Pebble Beach entrance.

Three Culverts will be installed.  The date to replace the front entrance culverts is Monday July 26th. Weather permitting, we are hoping it will take 3 to 4 days.  We will be using the gate located at Pebble Beach.(The same entrance we used during the flooding of the front entrance)

Along with this blog, Pat is going to send out the alert system over the phone, email, and we are going to put it on the marquee.  Hopefully we can let everyone know and keep them informed.
