Christmas Decorating time !!
Today was GREAT! People working everywhere! Some stringing lights, some decorating trees, and some were hanging wreaths. It was very obvious that a great deal of prep-work had been going on behind the scenes for several weeks. We owe a huge "Thank you" to many volunteers who all worked together under the direction of the Beautification Committee's own Kelly Kindrick and Judy Thy. Judy tells me there were at least 27 volunteers this year !!!
South Gate Installed
The South Gate is being manufactored, as of Thursday the 25th of last month. We hope to have it installed shortly. !

Friends of the Library Committee
Friends of the Library hard at work! Committee Chairman Virginia Paxton organized these new shelves with many thanks going to two men (who wish to remain anouymous) who built and installed the units.

Reba and Larry Brown hosted a luncheon today that was held at the Diamondhead Country Club. The Club provided a great meal. Reba Brown graciously invited me to join them for the festivities. Reba stated, “We are all excited to see what the Lord is doing, now.”

BILL OF ASSURANCE - Regarding Sign Issue
The issue of "For Sale" signs was brought up at last evening's Town Meeting.
Jack Plumlee [Riveria Utilities, and employee of Lee Young/Developer] has made it clear that no "For Sale" signs will be placed on any vacant lots. "This is a moot point."

Lake Catherine Water & Sewer Facility Board of Garland County
The Lake Catherine Water and Sewer Facility Board of Garland County met Tuesday, November 9th. The following slides were part of the presentation. Click on the picture to view a readable selection of each slide.

Also our purpose in life was started from Garland County Quorum Court under ordinance # 0-09-39 enacted on Sept. 14-2009 . Which stated that Lake Catherine is created for the purpose of acquiring, constructing, and equipping waterworks & sewer facility to serve the area within, and near the county known as "The Diamondhead Community" and to finance and refinance such facilities.
Garland County Judge Williams has overseen the administration of this board since its inception. His successor will take office on January 1, 2011.

This agreement is also contingent on 1) LCWSFB assuming Riviera's contract for water at whole-sale prices. 2) LCWSFB can assume Riviera's current licences with ADEQ (Arkansas Dept. of Environmental Quality) without any environmental changes or regulatory changes. 3) The USDA terms we are applying for include a fixed rate of 4.125% for 38 years. 4) Riviera's accounting firm would verify the financial information that has been provided. 5) LCWSFB would not be responsible for any of Riviera's financial liabilities. 6) A management agreement with Riviera's current employees would be in place.

Sunday's Meet the New General Manager
New General Manager, Eric Markle, shaking hands with a big smile on his face!
Debbie Clements prepared a wonderful wine and cheese gathering for all of Diamondhead to meet the new GM. Teresa Cummings & Ray Massey assisted in set-up. Thank you, it was warm and inviting to all of us!
Eric has been working long days and nights at full speed ! He is starting with the 19th Hole by preparing a chicken dinner that met rave reviews.

Public Notice
The Lake Catherine Waterworks and Sewer Facilities Board of Garland County is giving public notice of their intent to file an application for financial assistance with the USDA Rural Development Authority. The proposed project hopes to secure loan funds with which to purchase the water and sewer facilities now belonging to Riviera Utilities of Arkansas, Inc., and to operate those facilities for the benefit of the residents of the Diamondhead Community. This project will benefit Diamondhead residents and users in both Garland and Hot Spring Counties. There will be a public meeting at 7:00pm on November 9th, 2010 at the Clubhouse at Diamondhead, 245 Independence Drive, Hot Springs, Arkansas 72193. Information will be provided about the proposal and comments may be given concerning the project and any potential economic or environmental impact. Deb's Diamondhead Divas - Race for the Cure
Deb’s Diamondhead Divas have raised over $4,500 for
The Susan G. Komen Race for the Cure! Now over $5,000.00 - Four Season's Golf Club donated $200.00 !
This special group of women got together in the summer of 2009 when they found out their dear friend Deborah Farrar was diagnosed with breast cancer, and began chemotherapy and radiation treatments earlier that year.
Over the past year, the Divas group has grown from 18 original members to over 35! Monthly meetings are held, dues collected and over $4,500 has been raised from the Divas’ fundraising efforts, plus many friends and family.
Deborah has now begun another round of chemo, and we are all holding her up in prayer.
This will be the second year that the Divas will be participating in the Race for the Cure. We are proud of our accomplishment, and are proud of Deborah for being the strong fighter, great friend and wonderful person that she is.
There is always room for new Divas! We are beginning a new year of activities, meetings and fundraisers. If you have any questions about joining our group or just want more information, please call Deborah Farrar (262-4486), Kathy Pearce (781-5540), Angie MacFarlane (262-1895) or Laurie Timmons (262-0038).

Deer Poachers - Last Night
Last night between 8-9:30pm gun shots were heard near Concord and Scenic Drive. Deer Season can bring out negative behavior in some. The shots were from Deer Poachers and the police are aware of the incident.

General Manager update
The GM Search Committee narrowed the candidates down to 3. One has been eliminated without interview, and the two remaining have been interviewed. Board member, Doc Norwood, explained that both candidates are "very well qualified for the job". One has been tentatively selected to receive an offer from the Board.

The Finance Committee discussed “brain storming” for ideas to assist in Diamondhead’s recovery from this down turn in the housing market, i.e. the economy.

The Public Safety Committee met this evening. Members present included Joe Claflin, Dale Cline, Larry Johns, Charles Wood, Jerry McAnear, Matt Simpson, and Lyn Anderson.

I received a phone call from Terry Shipp declaring that he had nothing to do with the calling of this meeting, and demanding a retraction. Thank you, Terry, for the phone message. If I received the wrong information as to who called the meeting..... My sincerest apologies. The meeting has been canceled.
At least that was what Charles Wood believed as president of the POA Board. It takes 2 members of the board to call a Special Meeting. Mr Wood believed that Terry Shipp had been one of those members. The truth came out this evening. Doc Norwood and Betts Winsor called the Special Board Meeting without letting Jack Watson or Charles Wood know anything about it.....including the purpose for the meeting. The purpose was to replace Charles Wood as president.
The New elected officers of this Board are:

Police Shooting Victim's address to Diamondhead
Diane, at this time, we are not contemplating filing civil charges against Ensminger.
In the future, I respectfully advise the Board to utilize a Plan Of Correction when faced with adverse events such as those repeatedly created by Ensminger. As a former nursing home administrator, utilizing federal regulation requirements under adverse events, I would ask myself three questions;
1. What happened. Investigate the event and determine what happened.
2. What immediate steps did you take to correct the problem; i.e. termination, warning, etc.
3. What systems did you put into place to prevent the problem from reoccurring;
i.e. Training, immediate in service of all employees, policy changes and so on.
One last request.
Please don't rehire Ensminger as a Diamondhead police officer.
Cindy and I had never heard of or seen Fred Ensminger until 21 July, 2010.
If at all possible we wish not to see or hear from him ever again.

Police Shooting Update
Update on police shooting of July 21, 2010.

Fred Ensminger is out of the hospital recovering from the injury to his arm. Mr. Ensminger is not currently working for Diamondhead and is not receiving any compensation. All individuals involved have been advised by legal counsel not to say anything regarding this matter.
This is all the information I received as a Board Member. As President, I intend to find out everything I can concerning this issue. It is my goal to encourage transparency in the functions of the board and staff of Diamondhead.
I appreciate any concern you may have regarding this matter. Let it be known that I hear your concerns and will be obtaining this information and sharing it as it is received.

Bow Hunting Meeting !
Mike MacFarlane - Chairman of the WildLife Committee has called a meeting for September 15th. This meeting is for residents of Diamondhead, only. It will be held in the Club House at 7:pm.
Anyone with questions or concerns is encouraged to attend.

Karen Reagler of the Baim Law Firm will be conducting an estate planning seminar on Tuesday, September 21st from 6-7 p.m. in the banquet room at the Diamondhead Club House. She will discuss the basic documents that everyone should be aware of and plans to avoid family conflict and the court system. Karen will talk about the ins and outs of estate planning in language you can understand. There will be time for questions and answers after the seminar. I would like to thank each of you for supporting my re-election to the Diamondhead POA Board of Directors. As president, I am seeking your involvement in our community. The committees that serve, under the board's leadership, are vitally important to the Diamondhead membership in two primary ways.
We are in the process of recruiting members for our committees. It is my hope that you will seriously consider allowing Diamondhead to benefit from your unique talents. And, if you know of someone especially qualified in a particular area, I want to know about it !

The Annual Meeting was opened in prayer by Jim Willis. Board Secretary, Mary Pracht, read the minutes of last year’s meeting. These minutes should become available on the Community web-site: www.diamondheadcommunity.com
President Massey reported on the condition of the roads, thanking the Roads Committee for a “job well done”. Mr. Massey explained how the weather conditions last winter caused unexpected necessary repairs to the roads in our community…. “In excess of $150,000.00, most of which is complete.” The necessary repair to the culverts located in the entrance to Diamondhead added an additional expense. “It had to be done.” “I am pleased with the way the roads are going. Hopefully, we will be able to put, in the neighborhood of $150,000 a year toward the roads.
“As many of you know, one of the things that I was big on when I ran for the board, and was elected president of the board, was to get this facility. I felt like it was one of our amenities that was being denied to us when we sold the old country club. I felt like we deserved it. We did get it done, and we occupied this place on, or about, January 1st of this year. It has been doing well. As Todd has said many times, ‘It is a work in progress, we’re learning as we go’. We have had great leadership from him. And, also, Tina has done a tremendous job keeping this (19th Hole) organized. It is not an easy chore. We have had a lot of activities taken place here. During a wedding reception held here, Governor Mike Beebe was in attendance, as well as, Senator Blanche Lincoln. Regardless of your political views, when you can get a governor of the state and a US senator here in our club, it is something to be proud of.”
Our golf tournaments have increased since we’ve had this facility. Money from our outside play has increased tremendously. Our membership has fallen down, but our outside play seems to be somewhat making it up. I can only see bigger and better things for our golf course.
Another good thing that has happened to us is the Lion’s Club sponsoring Bingo. We have it on Saturday nights and it has provided an additional income for the POA. It has provided something fun and inexpensive to do.
DRC has done well this year, especially with their energy homes. They sold their spec house and their Easter Seals House as soon as it became available. They are building another on the South side. Every time they sell a house, that is good for us, because we get the additional income.
Also I am very proud of Eddie Gilbert and his crew. They are doing a great job. This is one of the best golf courses in the state that does not cost over $200.00 a round.
So, we have had a lot of good things going on. Everything has not been rosy all the time. I know that I’ve been a disappointment, a time or two, to different people. But, again, I’ll say, I’ve done my best, and I thank you for the opportunity I’ve had.

Note 9: Subsequent Events – Subsequent to March 31, 2010, the Association entered into an agreement with Diamondhead Condo Hotel, Ltd. (DCH). DCH is going to construct a family recreation center and condo/hotel, with no less than 100 units, outside of the Association’s gates. The Association granted rights to owners of the constructed units to use facilities of the Association at negotiated rates, all of which is contingent on DCH preselling 100 units. The ultimate outcome of these matters is not presently determinable; therefore, it is the opinion of management that the resolution will not have a material adverse effect on the financial position or results of operations of the Association.
Also, during the board meeting in July 2010, the board accepted the resignation of the Association’s general manager.

Chief Matt Simpson – Fire Department Report

Thank you for the fund-raiser held by Diamondhead Community Church which raised $6,000.00 for the rescue truck. This truck will soon be assembled and located in the ‘Big Blue building’. Many thanks go to Dean Hartwell for selling 270 tickets by himself ! …“He is a Dynamo!”
Last year we responded to over 800 calls. Just today alone, since 6am, we have had 8 calls.
We have been talking with an architect regarding a new building. This station will be large enough to house an ambulance. Just outside of the South gate, we hope to be able to build it… Diamondhead Reality has offered the land if we can raise the money for the building.
We have 74 volunteer fire-fighters on our roll, including a cadet crew. This is our 5th year to be recognized as a “Fire –Wise Community USA”. We are really proud of that.
Call the main station to speak with any members of this department - 1111 Hwy 290. If you have an emergency please call 911….. I am not home much.
Remember to use the control burn number in the phone book (623-4382). This will save you money and it saves us money.
On the Condo/Hotel, we are thrilled that the community is developing, but I didn’t know it was going to be 3-5 stories tall until the other day. That is going to add over a $100,000.00 worth of expense to the fire department to get the equipment to protect that building. I’m not sure where we are going to find that money, but we will have to add a second aerial truck to keep our ISO rating, which is what keeps your insurance low. We will have to add another ladder truck to the department. Which brings us to another place… where we are going to put it ? This makes that fire station even more important. We have all we can get in the Blue building right now. It is not tall enough to put one of those trucks in there, anyway.

But I really did want to please every single person out here. That is just my personality …..”

GM Search Update 8-23-10
Update on GM Search Committee:
The Committee will be narrowing down the search from (50?) applicants. The Finance Committee will be consulted regarding appropriate salary. If the salary meets the persons they want to interview, recomendations will be made to the Board.

A search committee has been formed to interview applicants for a new Diamondhead general manager. The committee members are: Frank Pohlkamp, Tom Wright, Jim Hannon, Joe Pelt, and Karen White. Adds have been place in the Sentinel Record and Demorcat Gazette requesting applicants to send their resume to the DPOA office. These adds will come out in this weekend and next weekend's papers.

Lake Catherine Water Standards
Update 8-23-10
Hi Diane,
Teresa and I both attended the "public hearing" on the water standards request. There were about 60 people in attendance and of those, I think only 1 or 2 in the crowd (UMETCO reps) were in support of raising...-or lowering- the standards. There were several people that spoke in opposition to the request including Judge Chris Williams, a retired fish biologist, two or three people that have lived in the area most of their life and have cancer, and the water standards rep from the Arkadelphia water department. There was NO ONE that spoke that was in favor of allowing the standards to be changed.

Complaint on Officer Fred

Re: Homeowner Complaint on Officer Fred
On Monday, June 28th, between 8pm and 9pm, Officer Fred responded to complaint calls about kids swimming in the lake at and near the Diamondhead Marina.
Upon initial contact with the young men, Office Fred began using profanity and abusive language, in violation of Arkansas Criminal Code covering disorderly conduct.. The oldest boy came out of water to speak to Office Fred, while the other 5 remained in the water. In response to these five boys not immediately exiting the water, Office Fred, according the Arkansas Criminal Code, statute 5-13-301, did make terroristic threats in the first degree upon these youth. His words, according to my three sons as well as the three other boys threatened: “The next time you kids try to hide from me, I’ll jump in there and drown you.”
See attachment for definition of Terroristic Threatening in the first degree. Terroristic Threatening in the first degree is a Class D felony.
Also on scene, driving up on golf cart was a Diamondhead property owner who’ve I’ve not yet identified, but will- who suggested to Officer Fred, “ You should shoot them”. According to all youth present, Officer Fred responded “Ha Ha, I will have enough bullets too.”
As of today, June 29th, 2010, I am requesting that Officer Fred be removed from his position of authority in the Diamondhead Community. I will be pursuing further sanctions against the possibility of Officer Fred working in a law enforcement capacity anywhere in the state of Arkansas. This letter should be viewed as a formal complaint against officer Fred, as well as the Diamondhead Police Department and the Diamondhead Community. Please provide a written response within 24 hours in regards to planned action against Office Fred and the Diamondhead Police Department.

Dear Mr. Belz:
Please accept this letter as notification of a formal complaint.
The Complaint is being filed against; Diamondhead POA, the Diamondhead Police Department, and a Diamondhead Patrol Officer identified here-in only as Officer “Fred”.
The Complaint is being filed by Michael and Kimberly Gilsinger on behalf of our minor child Jarrett Gilsinger, as Diamondhead Property Owners.
It is my understanding that on Monday, June 28th, 2010 sometime between the hours of 8pm and 9pm that Officer “Fred” confronted 6 individuals swimming in Lake Catherine near the Crazy Yankee Docks. Five of these individuals are minor children, and one is an 18 year old male. My son, Jarrett Gilsinger is one of the five minor children.
According to statements provided by the children, Officer Fred threatened my son and the other children by verbally stating “The next time you kids try to hide from me, I’ll jump in there, I don’t care about getting wet, and I’ll drown you.” This statement was delivered in a serious and aggressive manner and was interpreted as a literal threat by the children. Although my son did not hear all of the conversation between Officer Fred and the other children, he did hear one additional comment made by Officer Fred stating “I have enough bullets in my pocket too”. My son was then told by the other children that this comment was made by Officer Fred in response to another adult Male passerby’s suggestion to Officer Fred that “You should just shoot them”. My son is very upset as a result of this situation.
As Parents and Property Owners in Diamondhead we find Officer Fred’s behavior offensive and reprehensible. Additionally we believe Officer Fred is in violation of Arkansas Criminal Code Section 5-13-301(a)(1)(A), Terroristic threatening, which states;
“A person commits the offense of terroristic threatening in the first degree if:
(A) With the purpose of terrorizing another person, the person threatens to cause death or serious physical injury or substantial property damage to another person”
Because of his actions we are requesting that Officer Fred be permanently removed from the Diamondhead Police Department immediately.
We request that that you respond to our complaint in writing by Midnight July 1st, 2010.

Dear Mr. Belz:
Please accept this letter as notification of a formal complaint.
The Complaint is being filed against; Diamondhead POA, the Diamondhead Police Department, and a Diamondhead Patrol Officer identified here-in only as Officer “Fred”.
The Complaint is being filed by Michael and Kimberly Gilsinger on behalf of our minor child Jarrett Gilsinger, as Diamondhead Property Owners.
It is my understanding that on Monday, June 28th, 2010 sometime between the hours of 8pm and 9pm that Officer “Fred” confronted 6 individuals swimming in Lake Catherine near the Crazy Yankee Docks. Five of these individuals are minor children, and one is an 18 year old male. My son, Jarrett Gilsinger is one of the five minor children.

Board Meeting - 7-22-10
Board Meeting began at 7pm with President Massey asking for a moment of silent reflection.
The Board approved the June 24, 2010 minutes.

- 28 lots have been turned back to the POA. 5 of these lots are common property lots that are used by the community. 23 lots are turned over to Diamondhead Reality at $300.00 each.
- Golf Membership stands at 86. Terry Shipp; “I think the lesson we can learn here and try to overcome is … the more we raise the price the less revenues we have.
New Business
- The lease is up for 6 golf carts. Todd Belz made a request to purchase these carts at $1,500.00 each, for a total of $9,000.00. This motion was made by Tom Lockette and seconded by Tom Wright. Passed unanimously.
- Someone in our community, who wishes to remain anonymous, has graciously provided artwork to display in our Country Club. A motion was made and seconded to accept this gift. Motion passed unanimously.
- Frank Pohlkamp explained that the Board has their first home foreclosure. “This may be the first of many, so, we better learn how to deal with this kind of thing.”

Police Officer shot
Fred Ensminger is the name of the part-time, Off Duty, Diamondhead Police Officer that was shot last evening by a member of Diamondhead. Fred under went surgery today to remove the bullet from the bone in his shoulder. Your prayers are appreciated.
Board President, Raymond Massey explained the investigation has been turned over to Garland County; authorities outside of Diamondhead Community. Mr. Massey wanted to make it clear that the situation 'is under control'.
