April 26, 2012 Amended Board Meeting Minutes

Riviera / Lake Catherine Waterworks ~ purchase completed

Last Thursday, May 24, 2012, the purchase of Riviera Utility by the Lake Catherine Waterworks and Sewer Facilities Board of Garland County was completed. A $1.9M bond was issued and the money has been appropriately distributed. Jack plumlee is still the manager along with the other employees. Customers should see no difference in receiving monthly bills and paying at the same office.
 
This Utility will continue to be called 'Riviera' ~ "Customers will not see a change in service."

DPOA Insurance Company wants out !

Harleysville Worchester Insurance Company vs DPOA, et al

"I thought you might find this interesting….Jerry and Cindy have been served with a federal lawsuit filed by the insurance company that provided coverage for DPOA asking the Court to “reform” the insurance policy to exclude law enforcement activities.  Basically, the insurance company is trying to get off the hook and leave DPOA uninsured for the claims filed by my clients.
  The people of Diamondhead might want to know that information.

April of 2012 104 + we have possible 4 more to join soon. Our goal is to shoot for 110 by end of summer. Depending on success of Belvadere we could have the potential to pick-up several memberships by end of year.

Golf (Department 30) expenditures from Jan. 2011 to April 30, 2011: $107,076.18

Jan. 2012 to April 30, 2012: $58,990.43

Incoming revenue golf course. (“Greens fees”) Our numbers written down for this year’s green fees are not correct. The figures tell us this:

These figures are from Jan. to end of April:
2011 $8,925.63
2012 $12,262.62
Department 30 wage comparison, (golf/pro-shop) :
Jan. 2011 to end of April: $96,635.42
Jan. 2012 to end of April: $85,286.02 and this is with additional increases in insurance, taxes and unemployment claims we currently pay out. Wages only, without the unemployment claims for Jan.2012 to April 2012 : $67,886.46

New Phone Books are Here!!!

The Lions Club has completed the Diamondhead Phone Books  ~They are being deliever this week. 

If you do not recieve your phone book by Friday, please go by the front office to pick up your copy.

There will be extra copies this year.  So, if you need one for your car, they are available at the front office.  But not while you are driving!  :-)

Until then ... Daffodil Golf Tournament ~

DIAMONDHEAD BEAUTIFICATION COMMITTEE MEETING NOTES

TUESDAY, MAY 8, 2012 WHERE: AT THE FOUNTAIN-MEDIAN AREA
An informal meeting was held to discuss mulching bids for the median. The mulching will be done on Monday, May 14. There was a profit of $1200 from the Pancake Breakfast fund raiser. A Diagram of the Median electrical project was reviewed with Mr. Dean, and a copy will be given to the POA office for future reference.
Members and friends finished the weeding project that started the previous Thursday, May 3. Plantings were also placed in the median and around the fountain. The fountain water was turned on & filled up by Mr. D. Hartwell. Members present: Judy Thye, Char Donnelly, Kelly Kendrick, Kerry Crowe, Gail Porter, Sue Pelt, Kelly Yeager, and Martha.

Planning for the Daffodil Golf Tournament is at full speed. Betts Winsor is heading this project and request that the beautification committee members each bring a salad type dish or a vegetable type casserole dish for the tournament meal. Non members usually bring plenty of desserts which we are counting on also. Meat will be provided using Committee funds. Sign up for this Golf Four Person Scramble tournament at the Pro Shop. The cost is $30 per ticket and includes lots of food, fun, and prizes. Thanks to all who participate. See you there!!!!

Agenda Meeting 5-10-12

All Board members present except Doc Norwood

Subjects to be discussed at next week’s Town Meeting – May 17th

  • Sprinkler System ~ The system has been finished in the Banquet Room.  The contractors are working around the events / activities of DH members.
  • ACC Amendments ~ A new manual will be presented to the Board for approval at the Town meeting.
  • Capital Improvement Fund Proposal will be presented by Treasurer John Porter.  This is a ‘revamp’ of a resolution passed in 2000.
  • Golf Committee Request will be made by Golf Committee Chairman DeOtis Cotton.  Dan Munroe explained the need for funds to be set aside for ‘Green Replacement’.  An increase of the golf dues by $100.00 is also being requested.  The need for a golf operations manager was explained.  “Presently there is no one doing this job.”  Good discussion followed with contrary opinions and ideas passed around.  Agreement was reached regarding the need for marketing of our golf course.
  • Loitering ~ President Rick Noffsinger notified the Board of 5-8 boys that have been damaging property in the Kiddie Koral & swimming pool areas.  This has been occurring on Friday & Saturday nights between 3 or 4 o’clock in the mornings.  Curfew is being enforced.  However, some of these “youth” are over 18 years old.  Discussion ensued. Gated Communities do have the authority to set their own regulations.  Example: an all age curfew.  Public Safety Committee Liaison Joe Claflin was asked to study this situation.
  • Update on ponds – member sign in ~ It is being asked that residents inform the Front Gate of their intention to fish in the front ponds each day.  This will aid the security personnel in regulating the use by non-residents.  Signs will be posted with this information: “Private Property / No Trespassing”.  Game & Fish Commission demand all those fishing in the ponds have a fishing license or will be fined over $300.00.
  • Fire Department has increased its yearly dues; each home will be paying $70.00.
  • Roads Committee ~ Bob Jones ~ a straw vote was taken to approve the expenditure of $47,000 for the roads this year.
  • Landscape Maintenance~John Porter ~ requested a Board approval for the Landscape / Contract Labor since the project cost exceeds $1,500.00.  Motion was approved with John Porter & Jack Watson decenting.

Family Fun Center Contract - VOID

Dear Rick, Sarah, the Board, and Whom it may Concern,

I am forwarding you a copy of my March 19th email re: the "legality" of the Family Fun Center and any/all contractual agreement(s) pertaining thereto. Therein, I wish to reiterate the following point due to your request:
" As to the Fun Center contract, I did not draft the document, but did review it prior to execution. Technically, no Board action is required as the contract is void by definition under Arkansas due to default of the developer. "
This interpretation of Arkansas law is valid and I remain firm in my opinion that no further action by the DPOA is necessary or required to protect its interests.
