Town Meeting – January 22, 2015

Acting President Ken Benck welcomed Sharon Carr to the Board of Directors.

Committee Reports

Long Range Planning Committee – GM James Turner:  A ‘wish list’ has been received from the various department heads for the next 5 years.

Youth Committee – Kathy DeVilbiss: 
  • Kids Movie Night 6:pm à 8:pm on the last Saturday of the month.
  • Teen Movie Night 8:pm à 10:pm on the last Saturday of the month beginning in Feburary.  All movies will be “PG13”.
  • Yard Sale in late April
  • Frisbee / Disk Golf – information contact Kathy @ 609-5124
  • Committee’s goal is to resurface the basketball & tennis courts.

Social CommitteeDiane Jones reported for Mary Pracht:
  • Super Bowl Sunday – Chili Cook Off
    • $5 admission
    • Admission free with Chili to share
    • Prizes for First, Second, Third place winners

  • Discussion regarding Sex Offender notification.  Chief Tyner explained the Level II definition – Sex Offender DOES have access to Kiddie Coral & swimming pool.  Click here to view Notification
  • Oliver Wind – person responsible for sending out notification to ‘neighborhood’ where a sex offender resides.
  • POA member Stephenie Kessler made a request to add a regulation to the DPOA By-Laws restricting ‘sex offenders’ from living in Diamondhead.
    • Stephenie made a written request on Jan. 12th to speak on this issue at the Town meeting.  In response, Acting President Ken Benck stated, ‘Ask to get on the Agenda’.

Ensminger vs. Chambliss vs. DPOA:

Freedom of Information Act & Horizontal Property Act: 
  • These acts have been reviewed by DPOA Attorney - Carl A. Crow Jr.
  • Click here to view his opinion – “Therefore, the meetings of the board of directors of the POA are not “public meetings” within the meaning of this statute.

  • Vice President Ken Benck stated during the Town Meeting that the Horizontal Property Act was included in the Attorney’s statement.  It was not.


DPOA By-Laws was discussed:

            Article XIII:  Members, by the affirmative vote of a majority of a quorum of members present in person or by proxy  at a regular or special meeting amend, revise or supersede any of these By-Laws, provided the substance of the proposed amendment shall have been stated in the notice of the meeting.

Article II, Section 4:  Quorum  One Tenth (1/10) of the members shall constitute a quorum.

Article II, Section 2:  Special meetings may be called by the President, the Board of Directors, or upon the written request of not less than 10% of the members entitled to vote.

Sales Person hired:  Cara Matthews will receive 10% of sales as compensation.

Donation of $4,600 received for golf greens.

Suspension of golf privileges:  Chuck Emerick voiced his complaint against the Board of Directors for suspending his golf & amenity privileges after a ‘First Offence’.  The Board refused to hear his complaint.  “This is a mute issue”.

Arkansas Traffic Code:  Chief Joel Tyner explained the need to abide by
‘Arkansas Traffic Code’ as a regulation in Diamondhead.
  • This will give Joel authority in the court of law.
  • May assist in future collection of revenue from the state.
