By-Laws àinspection” of DHPOA books and records:  DH official web-site
Article X
Books and Records
The books, records and papers of the Association shall at all times, during reasonable business hours, be subject to inspection by any member of the Association for personal, non-commercial purposes.  The Bill of Assurance, the Articles of Incorporation and the By-Laws of the Association shall be available for inspection by any member at the principle office of the Association, where copies may be purchased at a reasonable cost.

This single word in our By-Laws has been ruled by the courts (2014) as ‘inspection only’.  Meaning:  no copies may be made or obtained from the DH POA office. Additional information may be found on 'Legal Issues' page of DH Community News / this Blog.

A question was asked: How can we change this word in our By-Laws to enable freedom to review documents?  It was stated that Hot Springs Village has ALL of their documents on-line for public viewing.  Why are we guarding our documents?  New Trend: Lenders are requesting financial status documents from HOA / POA (s) before a home-loan will be granted.  Are we loosing potential buyers due to this single word?  How may be change the wording of our By-Laws to allow for this freedom of information?
Answer:
Article XIV

Members, by the affirmative vote of a majority of a quorum of members
present in person or by proxy may at a regular or special meeting amend, revise or supersede any of these By-Laws, provided the substance of the proposed amendment shall have been stated in the notice of the meeting.
