Warning to Patrons of the 19th Hole

This meeting was intended to give the one and only warning to any and all 19^th Hole patrons that refuse to abide by the Arkansas State Laws concerning alcohol use.  

President Rick Noffsinger made it very clear that any infractions of the State law while on the property in and around the vicinity of the 19^th Hole will receive a citation from our Police department.  There will be no opportunity to say “I didn’t know…”.

These are NOT Diamondhead “Rules”, they are State Laws that will be followed to the letter.

            This Arkansas State Law contains:

1. No open container may leave the ‘gate’ on the patio.
2. No less than 3 12oz., unopened cans of beer may be ‘carried out’.  No wine glasses, beer mugs, metal buckets, etc. will leave the 19^th Hole.  Bring your own container to hold your CarryOut.  This may not be consumed on the 19^th Hole premises.
3. No one will be served who shows signs of being under the influence of alcohol intoxication.
4. No alcohol may be brought into the 19^th Hole perimeter – area that is under the Arkansas State Law referring to “Restaurant License Permit”.
5. No one is allowed to sit outside the 19^th Hole after the doors are locked with any alcohol.  This is called Public Consumption or drinking in public.  If the business is shut down, the License Permit Holder (Diamondhead) is cited, and held against our record.
6. At “Last Call” members may purchase whatever alcohol they wish to consume in the next 20 minutes.  At that time all buckets, pitchers, mugs, wine glasses will be picked up and the doors will be locked.
7. No alcohol will be consumed on the patio or parking area when the 19^th Hole is ‘closed’.  “Move your party elsewhere.”  When the doors are locked à everybody should leave the premises.
8. It will now be required for all Private functions held in the Banquet Room to pay for private security personnel.

Pictures were shown indicating the trash, empty beer cans, dumpster tipped over, broken glass, 11 pitchers, 22 beer mugs and wine glasses.  We don’t want to know where these individuals emptied their bladders!  Unfortunately, it was obvious.  Diamondhead residents left this mess last Friday night – March 30^st.  Rick explained his disbelief that members of our community would show that kind of disrespect.

Members are encouraged to ‘kindly’ ask others to abide by the State Law.  Police Chief Joel Tyner made it clear that no one should get into any kind of disturbance regarding this issue.  All infractions of the Law should be brought to the attention of the police department.  THEY will handle the issue either at the time of the infraction or the next day.  If there is a disturbance, ALL individuals will be arrested!

A question was asked:  “The people that are guilty of these actions are not here.  How are we going to get this message to them?”

Answer:  “They will be issued a citation and go to court to pay their fine.  This meeting is their only warning.”  This will be a Criminal Citation and will go against that individual’s record.

Police Chief Joel Tyner has done some research regarding security cameras for the parking lot area.  Members offered to assist in the cost of these cameras.

ABC Officer Charlie Davis stated that he “WILL WRITE THEM UP IF THEY ARE CROSSING THE LINE.  People in the city know what they can do and what they can’t do.  I don’t understand why Diamondhead can not figure this out.  You have got to support Joel (police department).”  

The DPOA has asked for a hearing to appeal the fine and probation from the ABC.  Charlie Davis explained that the ABC wants to encourage businesses to police themselves.  Charlie took note of the 80 members in attendance and will be taking this positive information back to the ABC Board.
